Events - Mayfair Townhouse Bakery

1. Definitions

Customer “ means the person booking the Session.

“Guest” means the Customer (if they are attending the Session which they have booked) together with, where appropriate, any other person whom the Customer books a Session for;

“TASCC” means Humble Creations Limited, a company incorporated in England with company number 11867929 (trading as The After School Cookie Club).

“ Session” means the event organised by TASCC which is the subject of a booking from the TASCC website.

“ Booking “ means the agreement between TASCC and the Customer in relation to a Session.

TASCC Venue” means TASCC’s Cookie Townhouse at 1-2 Weighhouse Street London W1K 5HJ (or such other venue as TASCC determines is necessary due to operational reasons).

2. All Bookings are issued subject to the rules of TASCC in relation to its TASCC Venue. Further, all Guests invited to a Session by a Customer are subject to these Terms and Conditions, as if they too were a party to the Booking (whether or not they were the Customer for the related Booking) except as expressly stated to the contrary in these terms and conditions.

3. Please check all relevant details before confirming your Booking. If a Customer makes a mistake, please contact TASCC as soon as possible at:

Mistakes related to a Booking may not always be capable of rectification. Whilst TASCC will act reasonably, they may determine that where a mistake is claimed in relation to a Booking, the Booking cannot or should not be rectified, for whatever reason. Any proposed rectification to a Booking by a Customer may incur a fee, as TASCC determines.

4. Similarly, where a Customer wishes to amend a Booking for any other reason, no such proposed amendment is permitted except as TASCC (acting reasonably) in its absolute discretion, so determines. Any such proposed amendment may incur a fee, as TASCC determines. Please contact our email address as stated in section 3 above to ask for a change to be made to a Booking.

5. Occasionally, a Session may have to be postponed or cancelled by TASCC. This may, for instance, occur for reasons outside its control (such as the demonstrator falling sick or otherwise not being available) or there is insufficient demand to warrant the running of such proposed Session. In extreme cases, it maybe that TASCC has to change the proposed TASCC Venue. In all such circumstances, TASCC will notify the Customer as soon as practicable . It is the responsibility of such Customer to notify any Guests related to such Booking of such change. If a Session cannot be rearranged for a time and date convenient to the Guests related to such Booking, a refund for the full price paid for such Booking will be made to the related Customer. Following such reimbursement, the Booking will then be deemed cancelled. In relation to any such cancellation, TASCC shall have no other liability whatsoever to any Guest connected to such Booking (whether or not any Guest alleges that they have suffered any direct or indirect damage as a result of such cancellation).

6. The Session shall take place at the TASCC Venue. TASCC reserves the right to refuse admission to a Session if it feels (acting reasonably) that a Guest might compromise the safety or security of other users of the TASCC Venue or might otherwise adversely affect the enjoyment of the other Guests. The TASCC Venue operates:

- CCTV; and

- a No Smoking Policy.

7. Whilst every reasonable effort to admit Guests who are latecomers to a Session will be made, admission in such circumstances cannot be guaranteed. Please refer to the FAQs as to how such a Guest’s enjoyment of the Session maybe impaired in such circumstances. No refund will be given in such circumstances.

8. TASCC has no responsibility for any personal property of any Guest. Any such property left in a TASCC Venue is entirely at the risk of the related Guest.

9. Before, during and after any Session, TASCC may record, in whatever media it determines, such Session (along with both the periods before and after such Session). This recording may include recording the Guests present at the time at the TASCC Venue. Each Guest, by attending the TASCC Venue, shall and shall be deemed to have consented to their being recorded, unless they have notified TASCC in writing to the contrary no later than before their Session commences (“Withdrawn Consent”). In this event, the Guest’s consent shall remain in full force and effect but shall be limited only to the extent described in the final paragraph of this Clause. TASCC shall be free to use, without charge or restriction, all such recordings including, without limitation, unrestricted use for the purposes of publicity, advertising or sales promotion. All copyright and all other intellectual property rights in relation to all aspects of the Session, are the exclusive property of TASCC. 

No Guest may record any Session in any form whatsoever. However, a Guest may take still photographs (but no sound or video) provided that : (a) it is for their own personal use only; and (b) they do not disrupt any other Guest or otherwise degrade such other Guest’s enjoyment of the Session.

In the circumstances where TASCC proposes to use a recording which includes a Guest who has Withdrawn Consent as described above, it shall ensure that whilst the Guest may still be shown/ heard in any such recording, the images and sound shall be changed so it will not be possible to identify such Guest.

10. Guests should wear clothing at each Session suitable for a lively, interactive and hopefully fun cooking event.

11. All personal data in relation to each Guest shall be held and used by TASCC, subject to TASCC’s data policy. Each Guest consents to such use of their data.

12. Each Booking and attendance at the TASCC Venue shall be governed by the laws of England and the courts of England shall have exclusive jurisdiction in relation to any matters or disputes arising out of or otherwise connected to any Booking.”



Online Gift Card Terms and Conditions

1. Validity and Redemption

1.1 This gift card ("Card") is redeemable exclusively for purchases through The After School Cookie Club's ("TASCC") online shop at www.theafterschoolcookieclub.com. This Card cannot be redeemed at any TASCC physical bakery locations or concessions.

1.2 The Card is valid for 12 months from the date of purchase.

1.3 Cards are automatically activated at the point of purchase by the person purchasing the Caed (the “Purchaser”). Either the Purchaser or if a third party(ies) is nominated by the Purchaser in the purchase order such person(s) (in each case termed the “Recipient”) will receive your Card via email with a unique redemption code (“Code”).

1.4 Individual Cards can be purchased with values of any of: £20, £30, £50 and £100.

2. Use and Balance

2.1 The Card value can be used in full or in part for any purchases at TASCC's online shop.

2.2 Any remaining balance after a transaction will stay on the Card for future use within the validity period.

2.3 The Recipient of the Card can check the Card balance on line by completing the Card voucher Code on the gift voucher page online, in accordance with the instructions. 

2.4 Multiple Cards can be used for a single online transaction, subject to our online checkout system capabilities.

3. Restrictions

3.1 Cards cannot be exchanged for cash or used to purchase other gift cards.

3.2 No cash refund will be given for any unused balance, except as required by law.

3.3 Cards cannot be used in conjunction with other promotions, offers or discounts unless expressly stated by TASCC.

3.4 Cards are not valid for purchases at any TASCC physical bakery locations or concessions, including in concessions operated by The After School Cookie Club.

3.5 Standard delivery charges apply to all online orders. The Card can be used towards delivery costs.

4. Loss, Theft and Damage

4.1 Cards are treated as cash. TASCC is not responsible for lost, stolen, or damaged Cards.

4.2 We may replace lost or stolen Cards at our sole discretion and, should we do so, on such terms and such evidence as we may reasonably require.

4.3 The Recipient must keep their Card details and Code secure. Anyone with access to such Card Code can use the remaining balance.

5. Consumer Rights

5.1 This Card is a payment instrument and therefore the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 right of cancellation does not apply to the purchase of this Card.

5.2 The statutory rights of the Purchaser and Recipient (if different) as a consumer are not affected by these terms and conditions.

5.3 If goods purchased with this Card are faulty or not as described, no statutory rights under the Consumer Rights Act 2015 are affected.

6. Online Purchase Terms

6.1 When purchasing a Card online, the Purchaser must provide accurate contact and email details. The Card will be delivered electronically to the email address(es) provided by the Purchaser.

6.2 TASCC is not responsible for Cards sent to incorrect email addresses provided by the Purchaser.

6.3 Cards are typically delivered by email within 24 hours of purchase, though this may take longer during peak periods.

6.4 The purchase price of the Card is non-refundable once the Card has been issued, except as required by law or at TASCC's discretion in exceptional circumstances.

7. General Terms

7.1 TASCC reserves the right to amend these terms and conditions at any time. Any changes will be posted on our website and will apply to Cards purchased 30 days after the date on which the change is first posted on our website.

7.2 TASCC may refuse to accept or replace a Card if we reasonably believe it has been obtained fraudulently or used in breach of these terms.

7.3 If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

7.4 These terms and conditions are governed by the laws of England and Wales, and, in relation to any Purchaser (and other Recipient of a Card), they and TASCC each agree to submit to the exclusive jurisdiction of the courts of England and Wales.

7.5 TASCC is not liable for any failure to perform its obligations where such failure is due to circumstances beyond its reasonable control.
